Welcome to Guest Harbor Inn! By completing your reservation, you agree to comply with the following Terms and Conditions. Please read them carefully before booking.
1. Reservation and Payment
- Reservation Confirmation: A reservation is considered confirmed only upon receipt of the required payment or deposit as specified at the time of booking.
- Payment Authorization: By providing a valid credit card, you authorize Guest Harbor Inn to charge the full amount for your stay, including room rates, taxes, service fees, and any incidental charges (e.g., parking, room service, damages, etc.).
- Special Requests: All special requests (such as early check-in, late check-out, or specific room preferences) are subject to availability and may incur additional charges.
- Credit Card Validity: Reservations must be made with a valid credit card. If the provided credit card is invalid or the charge cannot be processed, the reservation will be canceled.
2. Check-in and Check-out
- Photo ID and Credit Card: Guests are required to present a valid government-issued photo ID and a credit card upon check-in. This is necessary to verify the identity of the guest and secure any incidental charges.
- Check-in Time: Check-in is available from [3:00pm]. Early check-in is subject to availability and may incur additional fees.
- Check-out Time: Check-out time is by [11:00am]. Late check-out requests are subject to availability and additional fees.
3. Deposit and Fees
- Deposit Requirement: A deposit of $75 per stay is required at check-in. This deposit will be refunded at check-out, provided there are no damages or incidental charges.
- Additional Fees: Additional fees may apply for services such as parking, room service, or extra beds. These fees are not included in the room rate and will be charged separately.
4. Cancellation and No-Show Policy
- Free Cancellation: Cancellations are allowed up to 48 hours prior to the scheduled arrival date with no cancellation fee.
- Late Cancellations and No-Show: If you cancel or modify your reservation within 48 hours of the arrival date, or if you do not show up for your reservation, you will be charged 100% of the total reservation cost, including applicable taxes
5. Chargeback and Dispute Resolution
- Chargeback Policy: By completing your reservation, you agree that if any dispute arises regarding charges, you will first contact Guest Harbor Inn directly to resolve the issue. Chargebacks must not be initiated before attempts to resolve the issue directly with the hotel.
- Chargeback Fees: In the event of a chargeback, you agree to reimburse the hotel for any fees or penalties incurred as a result of the chargeback, including administrative fees, chargeback fees from the bank or payment processor, and any other associated costs.
- Fraud Prevention and Dispute Resolution:
- Fraudulent Transactions: By completing your reservation, you acknowledge that Guest Harbor Inn reserves the right to investigate any suspicious or potentially fraudulent transactions. If we suspect that a booking is fraudulent or made with unauthorized payment methods (such as stolen credit card information), Guest Harbor Inn reserves the right to cancel the reservation and/or refuse service to the guest.
- Verification of Payment: In cases where fraud is suspected, we may require additional verification, such as a valid government-issued photo ID, credit card verification, or other documentation, before confirming or processing your reservation. Guest Harbor Inn is not responsible for any delays or cancellations caused by the need for additional verification.
- Responsibility for Fraudulent Charges: If any fraudulent charges are identified after payment has been made, the guest agrees to fully cooperate with Guest Harbor Inn and law enforcement authorities to investigate the matter. The guest agrees to cover all costs associated with resolving fraudulent chargebacks, including administrative fees, legal fees, and chargeback fees.
- Chargeback Process and Fraudulent Claims: If a chargeback is filed due to suspected fraud, you agree that you will not dispute a charge with your bank or credit card issuer before attempting to resolve the issue directly with Guest Harbor Inn. In cases where Guest Harbor Inn is able to prove that the charge was legitimate, the guest may be held liable for the chargeback fee (which may range per chargeback) and any additional costs incurred.
- Legal Action for Fraud: Guest Harbor Inn reserves the right to pursue legal action against any guest found to be involved in fraudulent activities or using stolen credit card information. This may include reporting the fraudulent activity to law enforcement authorities and taking civil action to recover the funds.
- Indemnification: By completing your reservation, you agree to indemnify Guest Harbor Inn against any claims, damages, or losses arising from fraudulent use of payment methods or disputes related to fraud.
6. Arbitration Agreement
- Binding Arbitration: By completing your booking and agreeing to these Terms and Conditions, you agree that any dispute arising from your use of Guest Harbor Inn services or any transactions related to your reservation will be resolved through mandatory individual arbitration. This means that most disputes will not be handled in court and will be resolved through an arbitrator.
- Dispute Resolution: If a dispute arises, you agree to attempt to resolve it first through direct communication with the hotel. If the matter cannot be resolved informally, both parties agree to submit to binding arbitration under the rules of [Arbitration Provider].
7. Guest Responsibility and Property Use
- Guest Conduct: You agree to respect the comfort and safety of other guests and comply with all local laws and hotel policies during your stay.
- Damages: You are responsible for any damage caused to the hotel property during your stay, including the cost of repairs or replacement.
- Hotel's Right to Remove Guest: The hotel reserves the right to remove guests from the property without refund in the event of disruptive behavior or violation of hotel policies.
8. Smoking, Pets, and Other Policies
- Smoking Policy: Smoking is not permitted in any guest room or indoor public areas. Designated smoking areas are available on the property.
- Cleaning Fee for Smoking: If evidence of smoking is found in a guest room, a $250 cleaning fee will be applied to the credit card on file to cover the cost of deep cleaning. By confirming your reservation, you agree to this charge.
- Pet Policy: Pets are [not]: Only service animals are allowed at Guest Harbor Inn. Guests must notify the hotel in advance if they will be accompanied by a service animal. The service animal must always remain with the guest during their stay.
- Failure to Notify: If the hotel is not notified in advance of the presence of a service animal, the guest may be subject to a fee or the loss of their deposit. This is to ensure proper accommodations and to comply with hotel policies.
- Quiet Hours: Quiet hours are observed from [12 AM to 9 AM]. Please respect other guests during this time. Failure to comply with quiet hours may result in immediate removal from the property, with no refund of room charges or deposit.
9. Liability
- Limitation of Liability:
Guest Harbor Inn is not responsible for personal injury, loss, or damage to personal belongings during your stay. The hotel will not be liable for any loss, theft, or damage to personal items or property left unattended in guest rooms or public areas, including vehicles parked on the property. - Guest Responsibility for Property Damage:
Guests are responsible for any damage caused to the hotel property during their stay, including but not limited to damages to furniture, fixtures, and equipment. You agree to reimburse Guest Harbor Inn for the cost of repairs or replacement of damaged property. - Force Majeure:
Guest Harbor Inn is not liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, fire, flood, war, terrorism, labor strikes, civil unrest, government orders, or other force majeure events. If any such event affects your stay, Guest Harbor Inn will not be responsible for any damages or losses incurred, nor will the hotel provide compensation or refunds for cancellations, delays, or interruptions caused by such events. - Personal Injury:
Guest Harbor Inn is not liable for any injury sustained by guests on the premises, including injuries that occur in guest rooms, common areas, or parking lots. Guests are responsible for their own safety and the safety of their visitors while on the property. - Health and Safety:
The hotel is committed to providing a safe and healthy environment, but guests are responsible for ensuring their own health and safety during their stay. By confirming your reservation, you acknowledge that you are in good health and capable of using the hotel’s facilities and amenities. Guest Harbor Inn is not responsible for any health-related issues or injuries that occur as a result of the use of hotel facilities. - Indemnification:
You agree to indemnify and hold harmless Guest Harbor Inn, its employees, agents, and affiliates from any claims, damages, losses, or expenses, including legal fees, arising out of your stay, use of the hotel's facilities, or violation of any hotel policies. This includes, but is not limited to, claims related to personal injury, property damage, or disputes related to fraudulent charges or chargebacks. - Parking and Vehicles:
The hotel is not responsible for any damage, theft, or loss of property in vehicles parked on hotel premises, including vehicles parked in hotel-provided parking areas. Parking is at the guest's own risk. - Third-Party Services:
Any services or products offered by third-party providers (e.g., tour companies, external vendors, transportation, etc.) that are booked or utilized during your stay are the sole responsibility of the guest and/or the third party. Guest Harbor Inn will not be held liable for any issues, accidents, or disputes related to third-party services.
10. Governing Law
- These Terms and Conditions are governed by and construed in accordance with the laws of [State/Country]. Any disputes not subject to arbitration shall be handled in the courts located within [California].
11. Acceptance of Terms
By completing your reservation and confirming your booking, you confirm that you have read, understood, and agree to these Terms and Conditions, including all policies on cancellation, payment, chargebacks, fraud disputes, and arbitration.
